The Rec Room (“The Rec Room”, “we”, “us”, or “our”) respects your privacy and is committed to protecting your personal information. This Privacy Policy (the “Policy”) describes how we collect, use, disclose, store, and otherwise process information about you when you access or use the website located at https://therecroom.co.nz (the “Site”), The Rec Room mobile application (the “App”), and any related online or offline services (collectively, the “Service”).
This Policy applies to all users of the Service. By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by this Policy. If you do not agree with the terms of this Policy, you must not access or use the Service.

For the purposes of this Policy:
1.1 “Personal Data” means any information that relates to an identified or identifiable natural person.
1.2 “Usage Data” means information collected automatically, either generated by use of the Service or from the Service infrastructure itself.
1.3 “Cookies” means small files placed on your Device by a website or application.
1.4 “Device” means any device capable of accessing the Service, such as a computer, mobile phone, or digital tablet.
1.5 “You” means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service.

- INFORMATION WE COLLECT
We collect several types of information for the purposes of providing, maintaining, and improving the Service.
2.1 Personal Data
In the course of using the Service, we may request that you provide certain personally identifiable information that can be used to contact or identify you. Personal Data may include, but is not limited to:
(a) email address; (b) first name and last name; (c) telephone number; (d) postal address, including state, province, ZIP or postal code, and city; (e) date of birth and gender; (f) profile photograph; (g) emergency contact details; and (h) Cookies and Usage Data.
2.2 Mobile Application Data
When you access or use the App, we may collect additional categories of information necessary to provide the features and functionality of the App, including:
(a) Account and Profile Information: information you provide when you register, sign in, or update your profile;
(b) Health, Fitness, and Wellness Information: information you choose to record within the App, including but not limited to workout activity, attendance at classes and sessions, check-ins, body measurements, progress photographs, personal goals, and nutrition or meal-related entries;
(c) Booking and Membership Information: bookings, class registrations, attendance history, and membership status;
(d) Payment Information: payment-related information processed through our third-party payment providers. We do not store complete payment card details on our servers;
(e) Communications: messages, posts, and content you transmit through any in-App communication features;
(f) Device Information: device model, operating system and version, unique device identifiers, mobile network information, App version, language preference, and time zone;
(g) Push Notification Tokens: used to deliver reminders, updates, and notifications you have opted in to receive;
(h) Location Information: approximate or precise geolocation data, collected only where you have granted the relevant Device permission, and used for features such as locating nearby facilities or completing check-ins;
(i) Camera and Photo Library Access: collected only where you have granted the relevant Device permission, and used solely for the purpose of uploading profile photographs or progress photographs;
(j) Third-Party Health Data: health and activity data obtained from third-party sources (such as Apple Health or Google Fit), collected only where you have expressly connected such services and granted the necessary permissions; and
(k) Diagnostic and Performance Data: crash reports, error logs, and performance metrics used to identify and remediate issues in the App.
You may control many of these permissions at any time through the settings of your Device. Disabling certain permissions may limit the functionality of the App.
2.3 Usage Data
We may also collect information regarding how the Service is accessed and used (“Usage Data”). Usage Data may include:
(a) your Device’s Internet Protocol (IP) address; (b) browser type and version; (c) the pages of the Service that you visit; (d) the time and date of your visit; (e) the time spent on those pages; (f) unique device identifiers; and (g) other diagnostic data.
In respect of the App, Usage Data may additionally include the features you use, the screens you view, the actions you take within the App, session duration, and your interactions with notifications.
- HOW WE USE YOUR INFORMATION
The Rec Room uses the data collected for the following purposes:
(a) to provide, operate, and maintain the Service, including the App; (b) to create and manage your account; (c) to enable bookings, class registrations, check-ins, and other core features of the App; (d) to allow you to record and track your health, fitness, and wellness activity; (e) to send you reminders, updates, and push notifications that you have opted in to receive; (f) to notify you of changes to the Service; (g) to permit you to participate in interactive features of the Service when you so choose; (h) to provide customer care and support; (i) to process payments and manage memberships; (j) to provide analysis or other valuable information so that we may improve the Service; (k) to monitor the usage of the Service; and (l) to detect, prevent, and address technical issues, fraud, or other misuse.
- COOKIES AND SIMILAR TRACKING TECHNOLOGIES
4.1 We use Cookies and similar tracking technologies to monitor activity on our Service and store certain information.
4.2 Cookies are files containing a small amount of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your Device. Other tracking technologies we use include beacons, tags, and scripts, which are used to collect and track information and to improve and analyse the Service.
4.3 You may instruct your browser to refuse all Cookies or to indicate when a Cookie is being sent. However, if you do not accept Cookies, you may not be able to use certain portions of the Service.
4.4 In the App, we may use comparable technologies, including local storage, software development kits (SDKs), and unique identifiers, to provide equivalent functionality.
4.5 Examples of the Cookies we use:
(a) Session Cookies: used to operate the Service; (b) Preference Cookies: used to remember your preferences and various settings; and (c) Security Cookies: used for security purposes.
- DISCLOSURE OF INFORMATION
5.1 Legal Requirements
The Rec Room may disclose your Personal Data in the good-faith belief that such action is necessary to:
(a) comply with a legal obligation; (b) protect and defend the rights or property of The Rec Room; (c) prevent or investigate possible wrongdoing in connection with the Service; (d) protect the personal safety of users of the Service or members of the public; or (e) protect against legal liability.
- INTERNATIONAL TRANSFERS OF DATA
6.1 Your information, including Personal Data, may be transferred to and maintained on computers located outside of your state, province, country, or other governmental jurisdiction, where the data protection laws may differ from those of your jurisdiction.
6.2 If you are located outside New Zealand and choose to provide information to us, please note that we transfer the data, including Personal Data, to New Zealand and process it in New Zealand.
6.3 Your consent to this Policy, followed by your submission of such information, represents your agreement to that transfer.
6.4 The Rec Room will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Policy. No transfer of your Personal Data will take place to an organisation or country unless there are adequate controls in place, including measures to safeguard the security of your data and other personal information.
- DATA SECURITY
The security of your data is important to us. However, you should be aware that no method of transmission over the Internet, or method of electronic storage, is one hundred percent (100%) secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.
- THIRD-PARTY SERVICE PROVIDERS
8.1 We may engage third-party companies and individuals to facilitate the Service (“Service Providers”), to provide the Service on our behalf, to perform Service-related functions, or to assist us in analysing how the Service is used. This includes providers that assist us in operating the Site and the App, hosting data, processing payments, delivering communications and push notifications, and analysing performance and usage.
8.2 These third parties have access to your Personal Data only to the extent necessary to perform these tasks on our behalf and are contractually obligated not to disclose or use such information for any other purpose.
- ANALYTICS
9.1 We may use third-party Service Providers to monitor and analyse the use of the Service, including both the Site and the App.
9.2 Google Analytics. Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of the Service. This data is shared with other Google services. Google may use the collected data to contextualise and personalise the advertisements of its own advertising network. You may opt out of having your activity on the Service made available to Google Analytics by installing the Google Analytics opt-out browser add-on, which prevents the Google Analytics JavaScript (ga.js, analytics.js, and dc.js) from sharing information with Google Analytics about visit activity. - LINKS TO THIRD-PARTY SITES
10.1 The Service may contain links to other websites or services that are not operated by us. If you click on a third-party link, you will be directed to that third party’s website or service. We strongly advise you to review the privacy policy of every website you visit.
10.2 We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
- CHILDREN’S PRIVACY
11.1 The Service does not address any person under the age of eighteen (18) (“Children”).
11.2 We do not knowingly collect personally identifiable information from any person under the age of eighteen (18). If you are a parent or guardian and you become aware that your child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from Children without verification of parental consent, we will take steps to remove that information from our servers.

12.1 You may, at any time, review, update, or correct the Personal Data associated with your account through the relevant settings within the App or the Site, or by contacting us using the details set out in Section 14.
12.2 You may control App permissions, including location, camera, photo library, and notifications, through the settings of your Device.
12.3 You may unsubscribe from marketing communications by following the unsubscribe instructions contained in such communications or by contacting us directly.
- CHANGES TO THIS POLICY
13.1 We may update this Policy from time to time. We will notify you of any changes by posting the updated Policy on this page.
13.2 We will provide notice via email and/or a prominent notice on the Service prior to any change becoming effective and will update the “Effective Date” at the top of this Policy.
13.3 You are advised to review this Policy periodically for any changes. Changes to this Policy are effective when they are posted on this page.
